Recently there were a lot of changes made in the Companies Act and then there was introduction of Digital Signatures and changes were also made in the DIN rules. As a result of which all of us must have faced a lot of problems. So, i am posting few of the ammended changes of the DIN application rules appilcable to foreign directors. The changes are :-
A. Now, In case if the Director making an application is not present in India, in such cases document shall need to be attested by Indian consulate of the country where the director is present.
B. Also, In case proof of identity/ proof of residence is in language other than Hindi or English then the certified copy of the same in English or Hindi shall be required to be enclosed. It should be certified by the same professional who has certified other proof.
C. The identity proof enclosed with the DIN form should have date of birth of the individual entered in the form.
These changes are essentially for foreign directors. So if any of your client’s company’ directors are foreign nationals, then do not forget to advice your clients on above changes.
